Adsco.ai is a service operated by Creskor (Pty) Ltd, a company registered in South Africa (“Adsco.ai”, “Creskor”, “we”, “us”, or “our”).
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “you”, or “your”) and Creskor (Pty) Ltd governing your access to and use of the Adsco.ai platform, website, applications, APIs, integrations, and related services (collectively, the “Service”).
By accessing or using Adsco.ai you explicitly agree to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
Access to the service can be revoked at any time for violating the these terms, or our acceptable use policy.
1. Description of the Service
Adsco.ai is a software platform designed to assist users in creating, managing, optimizing, and analyzing digital advertising campaigns.
The Service may include, but is not limited to:
• Campaign generation tools
• AI-assisted advertising creation
• Campaign structure generation
• Advertising analytics and insights
• Integration with advertising platforms
• Campaign performance monitoring
• Budget management tools
• Automation features
• API integrations with third-party advertising platforms
The Service may integrate with third-party platforms including but not limited to:
• Google Ads
• Other digital advertising networks
• Analytics providers
• Payment processors
• Cloud infrastructure providers
Adsco.ai may modify, expand, restrict, or discontinue features at any time.
2. Eligibility
To use the Service you must:
• Be at least 18 years old
• Have the legal authority to enter into binding contracts
• Use the Service only for lawful purposes
If you are using the Service on behalf of a company, you represent that you have the authority to bind that company to these Terms.
3. Account Registration
Certain features require the creation of a user account.
You agree to:
• Provide accurate information
• Maintain updated account information
• Protect the confidentiality of your credentials
• Immediately notify us of unauthorized access
You are responsible for all activity that occurs under your account.
We are not liable for losses resulting from unauthorized use of your credentials.
4. License to Use the Service
Subject to compliance with these Terms, Adsco.ai grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service.
This license allows you to use the Service solely for your internal business purposes.
You may not:
• Copy or reproduce the platform
• Modify or create derivative works
• Reverse engineer or attempt to discover source code
• Rent, lease, or sublicense the platform
• Provide the platform as a service to third parties
Any unauthorized use terminates this license immediately.
5. Ownership of the Platform
The Service, including its software, architecture, algorithms, branding, documentation, and content, is the exclusive property of Creskor (Pty) Ltd or its licensors.
All intellectual property rights remain with Creskor.
These Terms do not grant ownership of the Service to users.
6. User Data and Content
Users may provide or connect data including:
• Business information
• Advertising account data
• Website data
• Campaign content
• Marketing assets
• Analytics data
You retain ownership of your data.
However, you grant Adsco.ai a license to process and use this data solely for:
• Operating the Service
• Improving platform functionality
• Delivering requested features
You represent that you have the legal right to provide this data to Adsco.ai.
7. Advertising Platform Integrations
Adsco.ai integrates with third-party advertising platforms.
These may include:
• Google Ads
• Analytics services
• Advertising networks
• Marketing platforms
Your use of those services is governed by their own terms and policies.
Adsco.ai does not control those platforms.
We are not responsible for:
• Platform account suspensions
• Platform policy violations
• Changes to third-party APIs
• Platform outages
• Advertising performance results
Users are responsible for complying with all advertising platform policies.
8. AI-Generated Content
Adsco.ai may generate advertising suggestions, campaign structures, or marketing content using automated systems.
These outputs are provided for assistance only.
Adsco.ai does not guarantee:
• Compliance with advertising platform rules
• Accuracy of generated outputs
• Advertising performance
• Revenue outcomes
Users must review and approve all generated content before use.
9. Subscription Plans and Payments
Adsco.ai operates on a subscription billing model.
Payments are processed by Lemon Squeezy, a payment provider owned by Stripe, which acts as the merchant of record.
By subscribing you authorize recurring charges based on your selected plan.
Billing intervals may include:
• Monthly
• Annual
• Other intervals specified during purchase
Fees are non-refundable except as described in the Refund & Cancellation Policy.
Adsco.ai may change pricing with reasonable notice.
10. Service Availability
We aim to maintain reliable service but do not guarantee uninterrupted availability.
The Service may experience:
• Scheduled maintenance
• System upgrades
• Technical outages
• Third-party infrastructure issues
Adsco.ai is not liable for downtime or service interruptions.
11. Beta Features
From time to time we may release beta features.
Beta features may:
• Contain bugs
• Change without notice
• Be discontinued
They are provided “as is” without warranties.
12. Security Responsibilities
Adsco.ai implements reasonable security safeguards.
However, users are responsible for:
• Securing their credentials
• Using strong passwords
• Maintaining control of connected advertising accounts
We are not responsible for security breaches caused by compromised user credentials.
13. Acceptable Use
You may not use Adsco.ai to:
• Violate advertising platform policies
• Conduct fraudulent activity
• Promote illegal goods or services
• Distribute malicious code
• Abuse or overload the platform
Violation may result in suspension or termination.
14. Suspension and Termination
We may suspend or terminate access if:
• You violate these Terms
• You misuse the platform
• Required by law
• Necessary to protect system integrity
Users may terminate their account at any time.
15. Data Retention
We may retain user data for a reasonable period after account termination for:
• Legal compliance
• Security purposes
• System integrity
Users may request deletion in accordance with our Privacy Policy.
16. Disclaimer of Warranties
The Service is provided “as is” and “as available.”
Adsco.ai disclaims all warranties including:
• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Continuous availability
We do not guarantee the Service will be error-free.
17. Limitation of Liability
To the maximum extent permitted by law, Creskor (Pty) Ltd shall not be liable for:
• Loss of profits
• Advertising losses
• Business interruption
• Loss of data
• Indirect or consequential damages
Total liability shall not exceed the fees paid by the user in the 2 months preceding the claim.
18. Indemnification
You agree to indemnify Creskor (Pty) Ltd from claims arising from:
• Your use of the Service
• Your advertising content
• Violations of platform policies
• Violations of applicable laws
• Any monetary loss associated with the use of this platform in any way
19. Force Majeure
Adsco.ai is not liable for delays or failure to perform caused by events beyond our reasonable control, including:
• Natural disasters
• Infrastructure failures
• Cyber attacks
• Government actions
• Internet disruptions
20. Export Compliance
Users agree to comply with all applicable export control laws.
The Service may not be used in jurisdictions subject to trade sanctions.
21. Governing Law
These Terms are governed by the laws of South Africa.
Disputes shall be resolved under South African jurisdiction.
22. Dispute Resolution
Before initiating legal action, the parties agree to attempt resolution through good faith negotiations.
Unresolved disputes may be referred to arbitration in South Africa.
23. Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
24. Entire Agreement
These Terms constitute the entire agreement between you and Creskor regarding the Service.
